It is always best to double check whether you meet the criteria, here is an outline:

The court will consider all circumstances of the case including:

- Any risk of significant harm to you or a relevant child, caused by the behaviour of the respondent, if the order is not made immediately.

- If it is likely the applicant will be deterred from pursuing the application if an order is not made immediately.

- Or whether there is reason to believe the respondent is aware of the proceedings and that the applicant or relevant child will be seriously affected by the delay involved.

If the court makes a without notice order, it must give the respondent an oppurunity to make representation about the order as soon as just and convient at a full hearing.
